Thanks for using our product. “YOGAEM” is provided by YOGAEM.com
By using YOGAEM, an app of YOGAEM.com, you have understood and accepted the terms and conditions (Terms of Use).

1. Basic Terms
1.1. You are responsible for any activity that occurs under your user account.
1.2. You are responsible for safeguarding the password that you use to access YOGAEM and for any activities or actions under your password.
1.3. You must not abuse, harass, threaten, Impersonate or intimidate other YOGAEM users.
1.4. You may not use YOGAEM for any illegal or unauthorized purpose. International users agree to comply with all local laws regarding online conduct and acceptable content.
1.5. You are solely responsible for your conduct and any data, text, information, screen names, photos, profiles, links that you submit, post and display on YOGAEM.
1.6. You must not copy, create a derivative work of, nor modify another app to falsely imply that it is associated with YOGAEM.
1.7. You must not upload, post, email, transmit, forward, provide links to, or otherwise make available any unsolicited or unauthorized advertising, promotional materials, “junk mail,” “spam,” ”chain letters,” ”pyramid schemes,” or any other form of solicitation to any YOGAEM users.
1.8. You must not interfere with or disrupt YOGAEM or servers or networks connected to YOGAEM.com such as the transmission of worms, viruses, or any code of a destructive nature applicable local, state, national, or international law.
1.9. You must not, in using YOGAEM, intentionally or unintentionally violate any application local, state, national, or international law.
Violation of any of these agreements will result in the termination of your YOGAEM account. While YOGAEM prohibits such conduct and content within the app, you understand and agree that YOGAEM.com cannot be responsible for the content posted on its app.

2. General Conditions
2.1. We reserve the right to modify or terminate the YOGAEM service for any reason, without notice at any time.
2.2. YOGAEM.com reserves the right to change or modify these Terms of User at any time, in its sole discretion, by posting changes at YOGAEM. Your continued use of YOGAEM will constitute your acceptance of such changes or modifications, what constitutes a “material change” will be determined at our sole discretion, in good faith and using common sense and reasonable judgment.
2.3. We reserve the right to refuse service to anyone for any reasonable judgment.
2.4. We may, but have no obligations to remove content and accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, and libelous. Defamatory, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Use.
2.5. As a condition of your use of YOGAEM, you agree that YOGAEM.com has the right, for any purpose, to retain, use and publish in an aggregate manner information collected from your user of the app.
2.6. We reserve the right to reclaim the usernames on behalf of businesses or individuals that hold legal claims or trademark on those usernames.

3. Disclaimer
The techniques and suggestions presented in YOGAEM application and website are not intended to substitute for proper medical advice. Consult your physician before beginning any new exercise program. The YOGAEM application and website assumes no responsibility for injuries suffered while practicing these techniques.

You agree not to use YOGAEM.com to:
1. Upload, post, email, transmit, forward, provide links to, or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable;
2. Upload, post, email, transmit, forward, provide links to, store or otherwise make available any material that infringes copyrighted material or promotes the violation of intellectual property rights of others, including but not limited to trademark and patent violations;
3. Upload, post, email, transmit, forward, provide links to, store or otherwise make available any unsolicited or unauthorized advertising, promotional materials, “junk mail”, “spam”, ”chain letters,” ”pyramid schemes,” or any other form of solicitation;
4. Impersonate any person or entity, including, but not limited to, YOGAEM.com officials, or falsely state or otherwise misrepresent your affiliation with a person or entity;
5. Disobey any requirement, procedures or policies or regulations connected to YOGAEM;

4. Subscriptions
4.1. We Offer In-App Purchases within YOGAEM App with the selection of Monthly subscription, Yearly Subscription and Lifetime Subscription.
4.2. Payment will be charged to the payment method (Paypal/Credit Card/ iTunes / Google Play/Venmo) you use to pay at confirmation of purchase
4.3. The subscriptions are automatically renewed unless turned off at least 24-hours before the end of the current period
4.4. A 14-day $1 Trial may be offered with the Monthly / Yearly Subscription. If you do not cancel the subscription before those 14 days is up, the the monthly / yearly will auto renew and you will be charged.
4.5. Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription to that publication.
4.6. We reserve the right, at our sole discretion, to modify or adjust current and future pricing models for the use of our service, at any time.

5. Community Terms
5.1. You own the content you create and share on YOGAEM Community, and nothing in these Terms takes away the rights you have to your own content. You are free to share your content with anyone else, wherever you want.
5.2. Specifically, when you share, post, or upload content that is covered by intellectual property rights (like photos) on or in connection with YOGAEM, you grant us a non-exclusive, transferable, sub-licensable, royalty-free, and worldwide license to host, use, distribute, modify, run, copy, publicly perform or display, translate, and create derivative works of your content along with your permission. This means, for example, that if you share a photo on YOGAEM, you give us permission to store, copy, and share it with others along with your permission.
5.3. YOGAEM takes intellectual property rights seriously and believes they are important to promoting expression, creativity, and innovation in our community. You own all of the content and information you post on YOGAEM, and you control how it is shared. However, before sharing content on YOGAEM, please be sure you have the right to do so. We ask that you respect other people’s copyrights, trademarks, and other legal rights. You take the responsibility of what you share. YOGAEM’s Terms of Service do not allow people to post content that violates someone else’s intellectual property rights, including copyright and trademark.
5.4. Please make sure that the copyright of the pictures you use in the community posts is owned by yourself, or has been authorized by the copyright owner. If a dispute arises due to illegal use, YOGAEM is not responsible for that, all consequences shall be borne by the user.

6. Refund Policy
6.1.Due to its virtuality, Premium is consumed once purchased. Hence, a refund is not available.
6.2. If the refund is eligible in line with the legislation or the situations judged by YOGAEM, a partial refund will be issued.
6.2.1. For in-app purchases made through the App Store, we do not have the right to issue any refunds. The only way to receive a refund for such purchases is to contact Apple.
6.2.2. For in-app purchases made through Google Play Store, our website, or Pay-Pal, if a refund is needed, there will be a deduction of 50% transaction fee and the fee of used Premium days. The order beyond 30 days after the payment will not be refunded.
6.2.3. Please be noted that automatic renewal of the service might occur for in-app purchases made through APP Store and Google Play Store. In such a case, refunds will not be issued. Users are responsible for canceling future renewals at the relevant APP market.
6.2.4. Lifetime subscriptions, gift card purchases, and promotional sales are not eligible for a refund.

7. Copyright
All the resources including the images, videos, audios and texts are protected by the trademark and copyright. Any use of the above sources without permission is illegal. All right, title, and interest in and to YOGAEM (excluding Content provided by users) are and will remain the exclusive property of YOGAEM and its licensors. The services are protected by copyright, trademark, and laws of all available countries. Nothing in the Terms gives you a right to use the YOGAEM name or any of the YOGAEM trademarks, logos, domain names, images, videos, audios and texts and other distinctive brand features. Any feedback, comments, or suggestions you may provide regarding YOGAEM is entirely voluntary and we will be free to use such feedback, comments or suggestions as we see fit and without any obligation to you.
